General terms and conditions

The General Terms and Conditions (GTC) are an important part of our online shop. They serve to define our contractual conditions and fulfil your information obligations. Our T&Cs include details of the ball markers we offer, prices, contract conclusion conditions, cancellation options and cancellation rights.

1. Scope of application
The following General Terms and Conditions (GTC) apply to all orders placed via our online shop.

(1) These GTC apply to all orders placed via our online shop by consumers (§ 13 BGB).
(2) Sales via the online shop are aimed exclusively at consumers. For business customers (B2B), an information page with contact details is available for individual enquiries.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Contractual partner

3 Conclusion of contract, correction options
(1) The presentation of products in the online shop is not a legally binding offer, but an invitation to place an order (invitatio ad offerendum).
(2) You can initially place products in the shopping basket without obligation and correct your entries at any time before submitting the order (e.g. via the input fields and "Back" functions provided in the order process).
(3) By clicking on the order button ("order with obligation to pay" or equivalent), you submit a binding offer to conclude a purchase contract for the goods in the shopping basket.

(4) Immediately after sending the order, you will receive a confirmation of receipt by e-mail. This does not constitute acceptance of your offer. The contract is only concluded when we expressly accept the order (e.g. by dispatch confirmation) or deliver the goods.

4. Contract language, storage of the contract text
(1) The contract language is German. An English version may also be provided; in case of doubt, the German version shall prevail.
(2) We store the text of the contract internally. Order data and terms and conditions will be sent to you by e-mail. If you have created a customer account, you can view past orders there.

5 Prices, dispatch, taxes/duties
(1) All prices are final prices in EUR including statutory VAT, plus any shipping costs incurred.
(2) The actual shipping costs incurred are displayed in the order process and shown on the last checkout page before the order is placed.
(3) For deliveries outside the EU (in particular CH, UK, USA), additional customs duties, taxes or fees may be incurred, which are to be borne by you and are not included in our prices/shipping costs.

6. Shipping costs, delivery area and delivery times

(1) Delivery area: Germany, EU member states, Switzerland. Further countries will be supported in the future; as soon as available, they will be selectable in the checkout.
(2) Germany: Standard shipping €3.90; free shipping for orders over €30.
(3) EU (DHL Standard, with shipment tracking): €6.90; free shipping for orders over €100.
(4) Delivery times: Unless otherwise stated for the product, the delivery time DE is 2-4 working days; for international shipments it varies depending on the destination country/service provider.
(5) We only deliver by dispatch to the delivery address specified in the order process. Collection by the customer is not possible.

7. Payment methods

The following payment methods are available in our shop. Payment is processed via Wix Payments (various payment methods available depending on the country) and PayPal.

(1) Credit and debit card (Visa, Mastercard, American Express, etc.) You enter your card details during the ordering process. Your account will be debited immediately after completing the order.

(2) Apple Pay / Google Pay The prerequisite is that you have activated the respective payment function in your end device. Your account will be debited immediately after completing the order.

(3) Sofortüberweisung / Klarna Sofort (if available) Payment is authorised via your online banking account. Your account will be debited immediately after completion of the order.

(4) PayPal To pay with PayPal, you must be registered there. After confirmation of the payment instruction, your PayPal account will be debited immediately after completion of the order.

(5) Other country-specific payment methods Wix Payments may offer other local payment methods (e.g. iDEAL, Bancontact) depending on the country of delivery. These will be displayed during the order process. Here too, you will be debited immediately after completing the order.

8 Retention of title

The goods remain our property until full payment has been made.

9. transport damage
If goods are delivered with obvious transport damage, please complain to the deliverer as soon as possible and contact us immediately. Failure to make a complaint has no effect on your legal claims; however, it helps us to enforce our own claims against the carrier.

10 Statutory liability for defects (warranty) & guarantee
(1) The statutory liability for defects applies.
(2) If there are additional manufacturer warranties, we will inform you of this with the product. Guarantees do not affect your statutory rights.

11. Liability
We shall be liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents:

in the event of injury to life, limb or health,

  • In the event of wilful or grossly negligent breach of duty,

  • In the case of guarantee promises, if agreed, or

  • Insofar as the scope of application of the Product Liability Act applies.

In the event of a slightly negligent breach of essential contractual obligations (so-called cardinal obligations), our liability shall be limited to the amount of damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
 Otherwise, claims for damages are excluded.

12. Right of cancellation
(1) Consumers have a 14-day right of cancellation. The details, including the sample cancellation form, can be found in the cancellation policy below.
(2) Exceptions: No personalized goods or goods made to individual specifications are sold. Limited edition goods are not exempt from cancellation unless they are personalized.

13. Dispute participation (VSBG)
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
Note: The former EU online dispute resolution platform (ODR) has been closed since 20/07/2025.

14. Applicable law
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The mandatory consumer protection regulations of the consumer's country of residence remain unaffected for consumers with their habitual residence in the EU.

Cancellation policy

Right of cancellation
You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.


To exercise your right of cancellation, you must contact us at Coinlygolf - Daniel Pelosato, Eichelbergstraße 2/3, 75245 Neulingen, e-mail: contact@coinlygolf.com, Phone: +49 176 56014194, by means of a clear statement (e.g. by letter or e-mail) of your decision to cancel this contract. You can use the attached sample cancellation form, but this is not mandatory.

Consequences of cancellation
If you cancel this contract, we will refund all payments we have received from you, including the standard delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your cancellation.


For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

Returns
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
Exclusion/cancellation of the right of cancellation

The right of cancellation does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (if relevant in the product range).
Not relevant for you: personalized/custom-made goods (not offered).
